When the International Court of Justice (ICJ) issued its July 2024 advisory opinion on Israel's presence in Judea, Samaria (the West Bank) and East Jerusalem, it framed the legal analysis almost exclusively around the "1967 baseline." This has become the default setting in international discourse: treating these areas as "Occupied Palestinian Territory" without reference to the legal framework that existed before.

Yet, the true legal foundation of modern Israel, and the region as a whole, begins not in 1967, but over four decades earlier. It is rooted in binding international commitments from 1920 and 1922 that partitioned the land long before any modern Palestinian statehood claim arose.

The 1922 League of Nations Mandate's Article 6 still legally binds the United Nations today

In the world of international diplomacy and the campaign to delegitimize Jewish sovereignty in its ancestral heartland, a foundational truth is often ignored. It is a truth not found in failed political agreements, but in international law.

That truth is the legal power of the Mandate for Palestine, specifically Article 6, and its clear instruction to “facilitate Jewish immigration “ and “close settlement by Jews on the land.”

The question of Israel’s sovereignty and the existence of a Palestinian state is not merely a political dispute but a matter of settled international law. Israel meets all criteria for statehood under the Montevideo Convention and has been recognized by 165 of 193 UN member states as of December 2020. Its borders, rooted in the 1922 British Mandate and affirmed by the United Nations in 1949, are legally incontestable. Conversely, Palestine fails to satisfy the foundational requirements of statehood, lacks broad international recognition, and has never exercised effective sovereignty over any territory. The mandates for Mesopotamia, Syria and Palestine were assigned by the Supreme Court of the League of Nations at its San Remo meeting in April 1920. Negotiations between Great Britain and the United States with regard to the Palestine mandate were successfully concluded in May 1922, and approved by the Council of the League of Nations in July 1922. The mandates for Palestine and Syria came into force simultaneously on September 29, 1922. In this document, the League of Nations recognized the "historical connection of the Jewish people with Palestine" and the "grounds for reconstituting their national home in that country."

Whereas the Principal Allied Powers have agreed, for the purpose of giving effect to the provisions of Article 22 of the Covenant of the League of Nations, to entrust to a Mandatory selected by the said Powers the administration of the territory of Palestine, which formerly belonged to the Turkish Empire, within such boundaries as may be fixed by them; and

Mandato para Palestina

En los próximos meses la nación de Israel cumplirá 70 años. Tras casi 2000 años, el pueblo judío vuelve a tomar posesión de su tierra. Un pueblo que ha perdurado en el tiempo gracias a que ha sabido conservar su cultura y su religión.


Hoy en día Israel ocupa un lugar preminente y sería impensable nuestro mundo sin Israel, pero no debemos olvidar cuanta sangre ha supuesto volver de nuevo a su tierra.

Reconocimiento de la Liga de las Naciones

A principios del siglo 20, el movimiento nacional judío ya había conseguido el apoyo internacional para la creación de un Estado judío en la tierra histórica de Israel.

El 24 de julio de 1922, la Sociedad de las Naciones, precursora de las Naciones Unidas, emitió un reconocimiento formal de la conexión de la nación judía con la tierra de Israel, y aprobó la decisión de establecer un Hogar Nacional Judío en la Tierra histórica de Israel.
