When the International Court of Justice (ICJ) issued its July 2024 advisory opinion on Israel's presence in Judea, Samaria (the West Bank) and East Jerusalem, it framed the legal analysis almost exclusively around the "1967 baseline." This has become the default setting in international discourse: treating these areas as "Occupied Palestinian Territory" without reference to the legal framework that existed before.

Yet, the true legal foundation of modern Israel, and the region as a whole, begins not in 1967, but over four decades earlier. It is rooted in binding international commitments from 1920 and 1922 that partitioned the land long before any modern Palestinian statehood claim arose.

In the world of international diplomacy and the campaign to delegitimize Jewish sovereignty in its ancestral heartland, a foundational truth is often ignored. It is a truth not found in failed political agreements, but in international law.

That truth is the legal power of the Mandate for Palestine, specifically Article 6, and its clear instruction to “facilitate Jewish immigration “ and “close settlement by Jews on the land.”

La Declaración Balfour: el renacimiento de una nación


El 2 de noviembre de 1917, el Ministro de Asuntos Exteriores británico, Lord Arthur James Balfour, envió una carta a Lord Lionel Walter Rothschild, un líder de la comunidad judía británica, en la que se leía:

El Gobierno de Su Majestad ve con buenos ojos el establecimiento en Palestina de un hogar nacional para el pueblo judío y hará todo lo posible para facilitar el logro de este objetivo, quedando claramente entendido que no se hará nada que pueda perjudicar los derechos civiles y religiosos de las comunidades no judías existentes en Palestina, o los derechos y el estatus político de que gozan los judíos en cualquier otro país.

I. Introduction

The question of Israel’s sovereignty and the existence of a Palestinian state is not merely a political dispute but a matter of settled international law. Israel meets all criteria for statehood under the Montevideo Convention and has been recognized by 165 of 193 UN member states as of December 2020. Its borders, rooted in the 1922 British Mandate and affirmed by the United Nations in 1949, are legally incontestable. Conversely, Palestine fails to satisfy the foundational requirements of statehood, lacks broad international recognition, and has never exercised effective sovereignty over any territory. El concepto del derecho palestino a un Estado propio, usado generalmente como explicación de una frustración palestina que hay quienes consideran al parecer que justifica cualquier cosa, también el terrorismo, es uno de los grandes engaños de la propaganda palestina. El Estado les fue ofrecido en distintos marcos, con distintas fórmulas, en diversas ocasiones, pero siempre lo rechazaron. Claro que el rechazo siempre se presentó en términos de injusticia y propuestas insuficientes, pero en realidad, el problema es que aceptar lo que se les ofrecía equivalía a poner fin al conflicto, renunciar a nuevas exigencias y reconocer al Estado de Israel.

El nervio motor árabe en general y árabe palestino en particular, nunca fue un Estado propio sino el “no” al Estado judío, sean cuales fuesen sus fronteras, diminutas e imposibles o no. Por eso rechazaron la las propuestas de la comisión Peel hace casi un siglo , así como la votación en la ONU en 1947 que proponía la partición de la Palestina del Mandato Británico en “un estado judío y otro árabe”, y todo lo que vino después.

Hundreds of Christian representatives present decree to ICJ affirming biblical connection of Israel to Judea and Samaria

Hundreds of Christians from 45 nations participated in a conference in support of Israel held in The Hague earlier this month. The event preceded the anticipated release on Friday of the International Court of Justice's (ICJ) non-binding advisory opinion on the legality of Israeli control over Judea, Samaria and East Jerusalem.

In November 2022, the ICJ was asked by a group of 98 nations to present an advisory opinion on Israel’s “prolonged occupation, settlement and annexation of Palestinian territory.”

Zionist Congresses: The Biltmore Conference (May 6 - 11, 1942)


The Biltmore Conference was called by the Extraordinary Zionist Conference, and was held from May 6 to May 11, 1942 in New York. Due to the war, no Zionist Congress could be held that year. The Extraordinary Zionist Conference was thus called to serve a similar purpose of forming Zionist policy.

Participants from a wide variety of Zionist organizations were represented at the Conference. The joint statement issued at the end of the session was known as the Biltmore Program. The Program reiterated Zionist demands for unrestricted Jewish immigration to Palestine and that Palestine should serve as a Jewish Commonwealth. This statement was the first in which non-Zionist organizations joined with their Zionist counterparts to publicly advocate the establishment of such a Jewish Commonwealth.

Rejection of President Trump’s “Deal of the Century” by Palestinian leaders has resulted in a stalemate that leaves Palestinians who desire national self-determination frustrated and angry. The problem is because of the fixation on creating a Palestinian state only west of the Jordan River. This has prevented thinking about any other options.
